NC Lawyers Weekly recently published an article titled, “Workers’ Compensation – Attorneys’ Fees – Attendant Care – Retroactive Award – Superior Court Review” discussing a workers’ compensation case that was taken to the Superior Court. In an appeal to superior court pursuant to N.C.G.S. § 97-90(c), an attorney secured a fee on attendant care services awarded to an injured worker. The award was held to fall within the discretion of the senior resident superior court judge based on an affidavit of consent from the care provider despite the absence of a fee contract and client relationship with the provider.
